Wine Special Order 

An individual or a retail permittee who wishes to purchase a wine product not on the Commission’s approved list of wines must first obtain a Wine Special Order permit as specified below:

Individuals with an approved special order permit may order and purchase wines not on the Commission’s approved list of wines for their personal consumption and for consumption by their bona fide guests. Restaurants with both the appropriate on-premise wine permit and an approved special order permit may order and purchase wine for resale to their patrons. The customer shall be of good character and reputation, have no record of violation of the ABC laws, and certify that his purchase is for the use of himself or bona fide guests or for use at a restaurant holding the appropriate on-premise wine permit. A special order permit is issued at no charge for one year and is good for all purchases made through the same retailer during that year. Orders for these purchases shall be made at licensed retail outlets that in turn place their orders with licensed wine wholesalers. These orders and purchases shall be made in case quantities not exceeding the legal limit for any one purchase. When the wholesaler or retailer possesses the wine, he shall also possess a copy of the permit. Any wine specially ordered shall meet the standards of identity and labeling requirements for wine outlined in product approval.

Amounts of alcoholic beverages that may be purchased:

  • Without a permit, a person may purchase at one time:
    1. Not more than 80 liters of malt beverages, other than draft malt beverages in kegs;
    2. Any amount of draft malt beverages in kegs;
    3. Not more than 50 liters of unfortified wine;
    4. Not more than eight liters of fortified wine.

    Individuals who purchase amounts in excess of what is stated must obtain a Wine Special Order permit as well as a Purchase Transportation Permit.
  • With a Purchase Transportation Permit, a person is authorized to transport from the place of purchase to the destination within North Carolina indicated on the permit at one time the following amount of alcoholic beverages:
    1. A maximum of 100 liters of unfortified wine;
    2. A maximum of 40 liters of fortified wine.

    A retailer placing a Wine Special Order is not limited to the statutory quantity limitations. Retail customer, retail permittee, and wholesaler should complete the appropriate sections of the Wine Special Order form.
    The applicant mails the completed form to the ABC Commission (Attention: Beer/Wine Product Compliance Division). Upon approval, a copy for the purchaser, retailer and wholesaler will be returned to the Wine Special Order customer by fax or mail. Please indicate preference.
    When the Wine Special Order customer places his order with a retailer, he should provide the retailer two copies of the Wine Special Order permit. In turn, the retailer provides the appropriate copy to the wholesaler. Thus, everyone handling a Wine Special Order is in possession of the Wine Special Order permit.
